The Case of Murder and Mutilation of Ayu Indraswari, Demand for Death Against the Defendant at the Sleman Trial

For his heinous act, Heru was demanded the death penalty by the public prosecutor. "The demand is death," said Agung Wijayanto, the Head of the General Criminal Section of the Sleman Prosecutor's Office yesterday (August 15, 2023). According to him, there are several reasons why the prosecution demanded the defendant to be sentenced to death. Among them is the fact that the act was carried out with planning, resulting in the loss of the victim's life.

"And the act was carried out in inhumane ways," added Agung.

In this trial, Heru only attended online through the Cebongan Correctional Facility where he is serving his detention. Agung revealed that the trial was conducted online because it was still required to be so. "Everything is still online because there is no agreement yet. It involves several agencies, not just the prosecutor's office," he said.

As is known, Heru's heinous act took place on Saturday (March 18, 2023), around 15:30 at Anggun 2 Inn in Pakem, Sleman. Heru himself is charged under Article 340 of the Indonesian Criminal Code regarding Premeditated Murder by the public prosecutor.

Furthermore, the next session will be in the form of a plea or defense agenda by the defendant against the prosecution's demand. The plea session is scheduled to take place on Tuesday (August 22, 2023). Heru will continue to be held in detention at the Cebongan Correctional Facility until the trial process is legally binding.

Responding to this death penalty demand, the defendant's legal counsel, Sri Karyani, stated that they would submit a plea in the next trial. According to her, the purpose of criminal punishment is to create welfare, uphold the supremacy of law and justice for humans, and to rehabilitate the defendant himself.

"And also to create a deterrent effect for potential criminals. Therefore, criminal punishment should be based on the principle of utility, where the principle is accompanied by the principles of justice and legal certainty," she concluded after the trial.
